Return Policy

This Return Policy describes the terms under which Sidephone products purchased directly from Sidephone may be returned for refund. This policy applies only to physical hardware devices and accessories. Software services, subscriptions, and mobile plans are governed by their respective terms.


1. Scope and Eligibility

This policy applies exclusively to:

  • Products purchased directly from sidephone.com

  • Orders placed and delivered within the United States

  • Physical Sidephone hardware devices and accessories

Purchases made through third-party retailers, resellers, or marketplaces are not eligible for return through Sidephone.

A valid proof of purchase is required for all returns.


2. Order Cancellation Before Shipment

Once an order has shipped, it becomes subject to this Return Policy.

Pre-orders and orders pending shipment may be cancelled at any time before shipment and are subject to the Order Cancellation Policy.


3. Return Eligibility Window

Standard Products

Products may be returned within 14 calendar days from the delivery date, as confirmed by carrier tracking.

Sidephone U.S. Founders Edition

Founders Edition customers may request a return within 30 calendar days from delivery.

A return request must be submitted before the applicable window expires.

There is no difference in eligibility timing between opened and unopened items.


4. Delivery Inspection Requirement

Customers must inspect their order promptly upon delivery.

Any of the following must be reported to Sidephone within 7 days of delivery:

  • Shipping damage

  • Missing items

  • Incorrect items

  • Visible defects on arrival

Issues reported after this period may not qualify for return under this policy and may instead be handled under the Warranty Policy.


5. Condition Requirements

To qualify for return, items must be returned with:

  • Original packaging

  • All accessories and components

  • Documentation and inserts

  • Promotional or bundled items

Devices must:

  • Be factory reset to remove all personal data

  • Not show damage caused by misuse or negligence

  • Not be modified, altered, or customized in any way (including skins, stickers, charms, or wraps)

  • Match the serial numbers associated with the original order

Customers are solely responsible for removing personal data before return. Sidephone is not responsible for any data remaining on returned devices.

If promotional or bundled items are not returned, their full retail value may be deducted from the refund or billed separately.


6. Condition Assessment and Restocking Fees

All returns are inspected at Sidephone’s facility in New York.

Refund amounts are determined according to the following condition categories:

1. Unopened

  • 5% restocking fee

2. Opened, No Identifiable Damage or Signs of Use

  • 10% restocking fee

  • Comparable to Grade A refurbishment condition

3. Opened, Minor Signs of Use or Cosmetic Blemishes

  • 25% restocking fee

  • Comparable to Grade B refurbishment condition

4. Opened, Wear Impacting Resale Value, and/or Missing Components

  • Return may be refused

  • Items considered Grade C or incomplete are not eligible for refund

Sidephone reserves the right to reduce or deny refunds if eligibility requirements are not met.

Photographic documentation of the assessment may be provided upon request.

If you disagree with the assessment, you may request that the product be returned to you. Sidephone will cover domestic return shipping in this circumstance. Once returned to you, the item is no longer eligible for refund.


7. Non-Refundable Items

The following items are not eligible for refund:

  • Final sale or clearance items

  • Customized or engraved products

  • Digital downloads or activated services

  • Shipping fees

  • Opened hygiene-sensitive accessories (e.g., earbuds)

  • Products damaged due to misuse, negligence, or unauthorized modification


8. Defective or Damaged Products

Products that arrive defective or damaged must be reported within 7 days of delivery.

Defects are handled under the Limited Warranty Policy, not this Return Policy.

Customers may be required to provide photographs, diagnostic information, or additional documentation when submitting a claim.


9. Return Authorization Process

Returns require prior authorization.

To initiate a return, email:

Subject line:
Product Return Request — Order #[Your Order Number]

Include:

  • Order number

  • Items being returned

  • Reason for return

If approved, Sidephone will issue a Return Merchandise Authorization (RMA) number and return instructions.

Returns sent without authorization may be refused.

The shipping address on your delivery package may not be the correct return address. You must obtain the official return address from Sidephone before shipping.

Sidephone is not responsible for packages returned without authorization or sent to incorrect addresses.


10. Shipping Requirements and Risk of Loss

For standard returns:

  • Customers are responsible for return shipping costs

  • Customers bear risk of loss during return transit

  • Insurance and tracking are strongly recommended

Customers are responsible for damage occurring during return shipment if caused by inadequate packaging.

Returns must originate from within the United States. Items shipped from outside the country of delivery cannot be accepted.


11. Shipping Timeline After Authorization

Authorized returns must be shipped within 10 days of approval.

Failure to ship within this period may result in cancellation of return eligibility.

Customers should provide tracking information after shipment.


12. Inspection and Response Timeline

After inspection, Sidephone will provide a condition assessment.

Customers have 10 days to accept or dispute the assessment.

If no response is received within this period, the return may be considered abandoned and the refund cancelled.

If an item is deemed abandoned, Sidephone may dispose of it after reasonable notice.


13. Refund Method and Processing

Approved refunds will be issued to the original payment method whenever possible.

If the original payment method is unavailable, refunds may be issued via:

  • Bank transfer

  • PayPal

  • Check

  • Store credit (if selected)

Refunds are typically processed within 5–10 business days after inspection and agreement on condition. Financial institutions may require additional processing time.

Customers remain responsible for any obligations to third-party payment providers until refunds are completed.


14. Shipping Fees

Original shipping fees are non-refundable.

Return shipping costs for standard returns are the customer’s responsibility.

Defective product shipping is handled under the Warranty Policy.


15. Exchanges

Sidephone does not offer direct product exchanges.

Customers may return eligible products for refund and place a new order separately.


16. Promotional Bundles and Discounts

If a purchase included bundled or promotional items:

  • The entire bundle must be returned

  • Missing items may be billed at full retail value

  • Discounts may be recalculated if part of a bundle is retained


17. Price Adjustment Protection

If the price of a Sidephone product is reduced within 7 days of your purchase, you may request a refund of the price difference.

Requests must be submitted within 14 days of the price change.


18. Fraud Prevention and Abuse

Sidephone reserves the right to refuse returns in cases of:

  • Serial number mismatches

  • Evidence of tampering

  • Excessive or abusive return patterns

  • Fraudulent activity or chargeback abuse

Accounts associated with fraudulent disputes may be restricted or suspended.


19. Relationship to Warranty

After the applicable return window expires, product issues are governed exclusively by the Limited Warranty Policy.


20. Limitation of Liability

To the maximum extent permitted by law:

  • Refund of the purchase price (minus applicable fees) is the sole remedy under this policy

  • Sidephone is not liable for incidental or consequential damages

  • Maximum liability shall not exceed the purchase price paid for the product


21. Legal Rights

This policy does not limit any rights you may have under applicable consumer protection laws.


22. Policy Changes

Sidephone reserves the right to modify this Return Policy at any time.

Changes apply only to purchases made after the updated effective date.
